Building Notice

A building surveyor may issue a building notice if they determine that some or all of the building work carried out on a project is non-compliant. But what exactly is a building notice, and what does it mean?

What is a building notice?

Under the Building Act 1993, a Municipal Building Surveyor can issue a notice to the owner of a building or piece of land. They can do this if, during an assessment or inspection, the surveyor discovers that work has been carried out without a building permit, or if the works carried out are not compliant with the relevant permit, codes and regulations.

The building notice itself will include a thorough explanation of the breaches or non-compliant work that was discovered. It will also include an explanation of why the notice was issued, and what must be done next. The following actions will depend on the reasons for the notice.

Once an owner has received a building notice, they often may be given the opportunity to justify why the work should remain as is. This is referred to as ‘to show cause’. During this process, the owner can engage the services of a private building surveyor to help outline corrective measures that will be taken. A building surveyor can also issue any permits that you need for the corrective works.

Alternatively, the owner can choose to demolish the non-compliant work. However, before demolition can take place, there will be reports that need to be completed and permits may be required. Again, a private surveyor is essential to this process.

What is a building order?

A building order is the next step in the process. This is issued if the owner does not reply to the building notice. Building orders come in three different forms – minor works, stop work, or emergency order. However, engaging a registered surveyor at the building notice stage should ensure that you avoid this eventuality.
